All driving instructors and vehicles used in connection with our Services must meet the specific requirements outlined in our [Driver Guidelines]. This includes maintaining proper licensing, insurance, and compliance with all local regulations. Failure to adhere to these requirements may result in account suspension or termination.

 

6. Payment Terms

To the maximum extent permitted by law, DRIVEx Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Services; or (d) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Services by any third party.


9. Dispute Resolution and Arbitration
 

Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in any class action lawsuits or class-wide arbitrations.

We reserve the right to terminate or suspend your access to the Services at any time, without notice and for any reason, including but not limited to your violation of these Terms.

● Applications refers to the Company iOS Driver app, iOS Customer app,

Android Driver app, Android Customer app.

● Account means a unique account created for you to access our Service or

parts of our Service.

● Company (referred to as either “the Company”, “We”, “Us” or “Our” in this

Agreement) refers to the Company.

● Cookies are small files that are placed on your computer, mobile device or

any other device by a website, containing the details of your browsing history

on that website among its many uses.

● Customer refers to a person that signs up to use the Company Service.

● Device means any device that can access the Service such as a computer, a

cell phone or a digital tablet.

● IP address: Every device connected to the Internet is assigned a number

known as an Internet protocol (IP) address. These numbers are usually

assigned in geographic blocks. An IP address can often be used to identify the

location from which a device is connecting to the Internet.
● Personal Data is any information that relates to an identified or identifiable

individual.

● Service refers to the Website and Applications.

● Service Provider means any natural or legal person who processes the data

on behalf of the Company. It refers to third-party companies or individuals

employed by the Company to facilitate the Service, to provide the Service on

behalf of the Company, to perform services related to the Service or to assist

the Company in analyzing how the Service is used.

of the Service or from the Service infrastructure itself (for example, the

purchased or enquired about unless you have opted not to receive such information.

● To manage your requests: To attend and manage your requests to us.

of some or all of our assets, whether as a going concern or as part of bankruptcy,

liquidation, or similar proceeding, in which Personal Data held by us about our

Service users is among the assets transferred.

analysis, identifying usage trends, determining the effectiveness of our promotional

campaigns and to evaluate and improve our Service, products, services, marketing

third parties such as advertisers, contest sponsors, promotional and marketing partners,

and others who provide our content or whose products or services we think may interest

We may share portions of our log file data, including IP addresses, for analytics

purposes with third parties such as web analytics partners, application developers, and

ad networks. If your IP address is shared, it may be used to estimate general location

and other technographics such as connection speed, whether you have visited the app

in a shared location, and type of the device used to visit the app. They may aggregate

information about our advertising and what you see on the app and then provide

auditing, research and reporting for us and our advertisers.

officials or private parties as we, in our sole discretion, believe necessary or appropriate

applicable court orders, laws, rules and regulations.

Retention of Your Personal Data

The Company will retain your Personal Data only for as long as is necessary for the purposes

to comply with our legal obligations (for example, if we are required to retain your data to comply

generally retained for a shorter period of time, except when this data is used to strengthen the

security or to improve the functionality of Our Service, or we are legally obligated to retain this
